A note from Daniel

Without some standard or goal as context, people would have no way to make anything but totally random judgments. At some level, the only way we can think is through analogy. It is how we advance our understanding in every realm, especially in the law. As Lloyd Weinreb writes, "Analogical reasoning does not undermine the rule of law but rather sustains it." Without analogy, law would never advance to address the challenges of its time effectively.
