Terms of Use

The agreement that covers your use of booksense, including Elite Membership.

Introduction

These Terms of Use ("Terms") govern your use of Booksense, our mobile application ("App"), and the booksense.app website. By using Booksense, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use Booksense.

These Terms form an agreement between you and Booksense. Apple is not a party to this agreement and is not responsible for Booksense or its content.

License

We grant you a non-exclusive, non-transferable, revocable license to use Booksense for your personal, non-commercial use. You may not use Booksense for any other purpose without our express written consent.

If you obtained Booksense from the App Store, this license is limited to use on any Apple-branded device that you own or control, as permitted by the App Store Terms of Service.

Your Account

You need an account to use most of Booksense. You are responsible for keeping your sign-in details secure and for everything that happens under your account. You must be at least 13 years old to create an account.

You may delete your account at any time from Settings in the App. Deleting your account removes your reading data as described in our Privacy Policy.

Elite Membership and Auto-Renewable Subscriptions

Booksense is free to use. Elite Membership is an optional paid subscription that unlocks additional features, including streak freezes, vacation mode, privacy options and other member perks described in the App.

Elite Membership is offered as an auto-renewable subscription on a monthly or yearly term. The length of the term and the price in your local currency are shown on the purchase screen before you confirm, and payment is charged to your Apple ID account at confirmation of purchase.

Your subscription renews automatically at the end of each term unless you turn off auto-renew at least 24 hours before the current term ends. Your Apple ID account is charged for renewal within 24 hours before the end of the current term, at the price for the plan you are on.

Any unused portion of a free trial period, where one is offered, is forfeited when you purchase a subscription.

Managing and Cancelling Your Subscription

You can manage your subscription and turn off auto-renew in your Apple ID account settings on your device, under Settings, your name, then Subscriptions. You can also reach the same setting from the Elite screen in the App.

Cancelling stops the next renewal. You keep access to Elite features until the end of the term you have already paid for, and a cancellation part-way through a term is not refunded on a pro-rata basis.

Purchases are processed by Apple, so refunds are handled by Apple rather than by us, under the App Store Terms of Service. You can request one through Apple at reportaproblem.apple.com.

Your Content

Notes, reviews, posts, photos, profile details and anything else you add to Booksense stay yours. You give us the permission we need to store your content and to show it inside the App to the people you have chosen to share it with, which is what makes the social features work.

You are responsible for what you post. Do not upload anything you do not have the right to share.

Acceptable Use

Do not use Booksense to harass, threaten or impersonate anyone, to post unlawful, hateful or sexually explicit material, to spam other readers, or to break any law.

Do not attempt to access accounts that are not yours, interfere with the service, scrape it, or work around any technical limit or paid feature gate.

You can report a post or a reader from within the App, and you can block another reader at any time.

Intellectual Property

Booksense and all content and materials contained in Booksense are the property of Booksense owner or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on Booksense or any content or materials contained in Booksense without our express written consent.

Book Data and Third-Party Services

Book details such as covers, descriptions, page counts and categories come from third-party sources, including Google Books, Open Library and Wikipedia, and remain the property of their respective owners. We show this information as we receive it and cannot guarantee that every detail is accurate or complete.

Where you import a library from another reading service, you are responsible for having the right to the data you upload.

Termination

You may stop using Booksense and delete your account at any time. We may suspend or close an account that breaks these Terms, or withdraw the service, with notice where it is reasonable to give it.

If we close your account for a reason other than a breach of these Terms, and you have an active Elite Membership, you can ask Apple for a refund of the unused part of your term.

Disclaimers

Booksense is provided "as is" and without warranty of any kind, whether express, implied, or statutory. We do not warrant that Booksense will be uninterrupted or error-free, or that any defects in Booksense will be corrected. We are not responsible for any damage to your device or loss of data that may result from your use of Booksense.

Limitation of Liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, or consequential damages arising from your use of Booksense.

Changes to these Terms

We may update these Terms from time to time. Where a change is significant we will let you know in the App. Your continued use of Booksense after a change takes effect means you accept the revised Terms.
